Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Big Brainer Intelligence PRO (the “Service”) operated by Big Brainer Intelligence (“we”, “us”, “our”). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Big Brainer is a statistical football match analysis platform. We generate probability estimates, calibrated tiers, recommended picks, and full intelligence reports for football fixtures across a curated set of leagues. The Service is an analysis and information tool. It is not a betting tipster, financial advisor, bookmaker, or guarantor of outcomes.

2. Eligibility

  • You must be at least 18 years old (or the legal gambling age in your jurisdiction, whichever is higher) to use the Service.
  • You must use the Service only in jurisdictions where it is legal to access information about sports outcomes and where any betting activity you undertake separately is legal.
  • You are responsible for verifying the legality of using this Service and any associated activity in your jurisdiction.

3. Accounts

  • You create an account by providing a valid email address and password.
  • You are responsible for keeping your credentials confidential.
  • You are responsible for all activity that occurs under your account.
  • You may delete your account at any time by contacting support.
  • We may suspend or terminate accounts that violate these Terms or applicable law.

4. Subscription Plans

The Service offers a free tier and paid subscription plans (Pro, Premium). Plan features, prices and limits are described on the pricing page. We reserve the right to modify plan features and pricing with reasonable notice. Paid plans are billed in advance for the chosen period; refunds are issued at our discretion for technical faults attributable to us.

5. No Guarantee of Results

Football outcomes are inherently uncertain. Our model outputs probabilities — not certainties. Past performance of any model, league, or pick category does not guarantee future results. You alone decide whether to act on any information we provide, and you alone bear the consequences of those decisions.

6. Not Financial or Betting Advice

Information provided through the Service is for informational and educational purposes only. It is not investment advice, financial advice, betting advice, or a recommendation to place any wager. Nothing in the Service should be construed as a solicitation to gamble or an endorsement of any particular bookmaker.

7. Responsible Use

If you choose to gamble using insights from the Service, you must do so responsibly. Never bet more than you can afford to lose. See our Responsible Gambling page for guidance and helplines.

8. Intellectual Property

All content, source code, models, designs and trademarks of the Service are the property of Big Brainer Intelligence or its licensors. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial use only. You may not scrape, reverse-engineer, resell, or republish Service output without prior written consent.

9. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose.
  • Attempt to bypass authentication, rate limits, or security measures.
  • Automate the collection of data from the Service (scraping) beyond published API limits and your subscription tier.
  • Use the Service to develop a competing product.
  • Impersonate another person or misrepresent your identity.

10. Third-Party Services

The Service relies on third parties (Supabase for authentication, Vercel for hosting, API-Football for fixtures and odds). Their availability and terms govern parts of the experience. We are not liable for outages, errors, or changes in third-party services.

11. Service Availability

We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance, infrastructure outages, or factors beyond our control may cause downtime. We are not liable for losses resulting from downtime.

12. Limitation of Liability

To the maximum extent permitted by law, Big Brainer Intelligence is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or gambling losses, even if advised of the possibility. Our total cumulative liability for any claim arising out of these Terms is limited to the amount you paid us in the 12 months preceding the claim (or USD 0 if you are on the free tier).

13. Termination

We may terminate or suspend your access immediately for breach of these Terms. You may terminate your account at any time. On termination, your right to use the Service ends; provisions that by their nature survive termination (intellectual property, limitation of liability, governing law) continue to apply.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice. Continued use of the Service after the effective date of a change constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the United Republic of Tanzania, without regard to conflict-of-law principles. Any dispute will be submitted to the exclusive jurisdiction of the competent courts of Tanzania, unless mandatory consumer-protection laws of your jurisdiction require otherwise.
